Tehran (Bazaar): The meeting of the International Atomic Energy Agency Board of Governor was held two days ago while the issue of Iran and Joint Comprehensive Plan of Action (JCPoA) were highlighted. This meeting of the Board of Governors was crucial in designing the future direction of JCPoA , as US efforts to pass a resolution indicated the possible complete destruction of JCPoA .
The draft of resolution was distributed among the members by UK with probable changes which was provided to the Bazaar reporter by IAEA source.
Following is the text of the draft of the resolution operational clauses:
(a) Emphasizing the essential and independent role of the IAEA in verifying Iran’s compliance with its safeguards obligations and Iran’s nuclear-related commitments under the Joint Comprehensive Plan of Action (JCPoA); and appreciating the professional and impartial efforts of the Director General and the IAEA Secretariat to implement Iran’s safeguards agreements and verification and monitoring activities under the JCPoA;
(b) Recalling the Board’s decision on 25 August 2015 to authorise the Director General (ref GOV/2015/53) to implement the necessary verification and monitoring of Iran’s nuclear-related commitments as set out in the JCPoA, and report accordingly, for the full duration of those commitments in light of United Nations Security Council Resolution 2231 (2015);
(c) Taking note with grave concern of Iran’s letter to the Agency dated 15 February 2021 informing the Agency that Iran will stop, as of 23 February 2021, the implementation of provisions of the Additional Protocol, the modified Code 3.1, as well as all transparency measures envisaged in the JCPoA;
(d) Welcoming with full support the Director General’s efforts to continue essential verification activities in Iran, and positively acknowledging the temporary bilateral technical understanding achieved with Iran in light of Iran’s decision to stop implementation of nuclear verification measures under the JCPoA and Iran’s decision to stop implementing provisions of its Additional
Protocol;
(e) Recalling the Board’s Resolution of 19 June 2020, GOV/2020/34, which reaffirmed that Iran shall cooperate fully and in a timely manner with the IAEA in implementing its Comprehensive Safeguards Agreement and Additional Protocol, and called on Iran to satisfy the Agency’s requests without any further delay;
(f) Noting with deep concern the Director General’s report in GOV/2021/15 and reference to outstanding safeguards issues.
Operative Paragraphs:
1. Reiterates its full support for the professional and impartial efforts of the Director General and the Secretariat to implement the Comprehensive
Safeguards Agreement and Additional Protocol in Iran, and to implement its verification and monitoring activities under the JCPoA
2. Expresses serious concern at Iran’s decision to stop implementing provisions of the Additional Protocol and nuclear-related commitments under the JCPoA, in particular its steps contrary to its JCPoA commitments related to the IAEA’s verification and monitoring activities under the JCPoA;
3. Underlines that the implementation of the Additional Protocol in Iran provides
additional information and access to enable increased assurances regarding the absence of undeclared nuclear material and activities in Iran, and that necessary IAEA verification of Iran’s nuclear related commitments under the JCPOA is essential in enabling the IAEA to fulfil its verification mandate; and recalls that without implementation of an Additional Protocol, the IAEA cannot reach the Broader Conclusion that all nuclear material in Iran remains in peaceful activities;
4. Further underlines that, as noted by the Director General in his report of 23 February 2021, contained in GOV/2021/15, “implementation of the modified Code 3.1 is a legal obligation for Iran under the Subsidiary Arrangements to its Safeguards Agreement which (…) cannot be modified unilaterally”, and reaffirms that Iran is legally obliged to implement modified Code 3.1 under its Comprehensive Safeguards Agreement;
5. Expresses concern regarding Iran’s decision not to allow the IAEA to verify and monitor implementation of Iran’s nuclear-related JCPoA commitments, and to stop implementing provisions of the Additional Protocol, and underscores that the absence of these verification measures will have a detrimental impact on the IAEA’s ability to fulfil its reporting mandate;
6. Urges Iran to immediately resume implementation of the Additional Protocol, to immediately reinstate IAEA verification and transparency measures provided for under the JCPOA and to comply with modified Code 3.1 of its Comprehensive Safeguards Agreement;
7. Shares the IAEA’s deep concern, expressed in the Director General’s report GOV/2021/15 of 23 February 2021, at the lack of progress in clarifying the safeguards issues, and calls on Iran to full cooperate with the Agency to clarify and resolve these issues without further delay;
8. Requests the Director General to continue to report any further development to the Board of Governors on these matters as appropriate;
9. Decides to remain seized of the matter.
